Human trafficking or human smuggling
Both crimes have different meanings. Human trafficking involves recruiting, transporting, transferring, harbouring, sheltering, taking or transferring control of a person in order to exploit that person. The aim is to obtain a (financial) benefit from this exploitation.
The following acts may be the subject of human trafficking:
- exploitation of prostitution or other forms of sexual exploitation
- exploitation in begging
- offering work or services in conditions contrary to human dignity
- removal of organs or human bodily material
- Forcing someone to commit a crime or wrongdoing (in some cases, dealing drugs or committing thefts)
Human smuggling involves financial gain by helping someone cross the border or cooperating in this (e.g. by providing accommodation to the illegal person afterwards).
Human smuggling is criminalised in the Aliens Act while human trafficking can be found in the Penal Code.
Slander and defamation
There is an important difference between libel and defamation. When someone maliciously spreads accusations about a person, this can be punishable.
Slander is publicly and maliciously accusing someone of something without providing any evidence while the law states that this crime must be proven. This is the case, for example, when you are publicly accused of rape when there is completely no evidence for this.
Honour robbery is maliciously accusing someone of something so that that person's honour is (publicly) tarnished, without proof of this being legally possible or permissible. This is the case, for example, when someone has been finally acquitted for a crime, but he is persistently accused by the victim.
